The article deals with the evaluation of loans left in crisis according to § 17 para. 2a sentence 3 no. 2 EStG (German Income Tax Act). A loss from such a loan is not taken into account under § 20 EStG if the loss occurred before December 31, 2008. The case of a shareholder loan left in crisis is given as an example for the application of these regulations. The tax court and the Federal Fiscal Court have decided that the alleged loan loss cannot be recognized. The present text deals with various judgments of the Federal Fiscal Court (BFH) on the topic of dissolution loss and subsequent acquisition costs within the framework of the Income Tax Act (EStG). It is explained that after the abolition of the equity replacement law by the Law on the Modernization of the GmbH Law and the Combating of Abuses of October 23, 2008, the previous case law on the consideration of expenses by the shareholder from equity-replacing financing aids as subsequent acquisition costs continues to apply. In addition, the legal basis for the consideration of acquisition costs within the framework of § 17 EStG is discussed, which was introduced by the Law on Further Tax Incentives for Electromobility and Amendment of Other Tax Regulations. It is emphasized that the principles for the consideration of equity-replacing financing aids as subsequent acquisition costs continue to apply. The wording of the law does not contradict this. Der Artikel behandelt die Bewertung von in der Krise stehengelassenen Darlehen gemäß § 17 Abs. 2a Satz 3 Nr. 2 EStG. Ein Verlust aus einem solchen Darlehen wird nicht bei § 20 EStG berücksichtigt, wenn der Verlust vor dem 31.12.2008 eingetreten ist. Der Fall eines in der Krise stehengelassenen Gesellschafterdarlehens wird als Beispiel für die Anwendung dieser Regelungen genannt. Das Finanzgericht und der Bundesfinanzhof haben entschieden, dass der behauptete Darlehensverlust nicht anerkannt werden kann. Der vorliegende Text befasst sich mit verschiedenen Urteilen des Bundesfinanzhofs (BFH) zum Thema Auflösungsverlust und nachträgliche Anschaffungskosten im Rahmen des Einkommensteuergesetzes (EStG). Es wird betont, dass die Grundsätze zur Berücksichtigung eigenkapitalersetzender Finanzierungshilfen als nachträgliche Anschaffungskosten fortgelten. Der Wortlaut des Gesetzes steht dem nicht entgegen. Der Text behandelt die Anwendung von Grundsätzen zur Bewertung nachträglicher Anschaffungskosten gemäß § 17 Abs. 2a EStG. Es wird darauf hingewiesen, dass Darlehensverluste nur in dem Umfang berücksichtigt werden können, wie sie gesellschaftsrechtlich veranlasst sind. Die Anwendung der Grundsätze zur Bewertung nachträglicher Anschaffungskosten entspricht dem Sinn und Zweck des Gesetzes und dem objektiven Nettoprinzip. Der Text behandelt die gesellschaftsrechtliche Veranlassung von Darlehensverlusten gemäß § 17 Abs. 2a Satz 3 Nr. 2 und Abs. 2a Satz 4 EStG. Es wird festgestellt, dass eine solche Veranlassung nur in Höhe des Teilwerts des Darlehens bei Eintritt in die Krise besteht. Es wird argumentiert, dass die bisherigen Bewertungsgrundsätze beibehalten werden sollten und dass systematische Erwägungen für diese Beibehaltung sprechen. Darüber hinaus wird erläutert, dass Darlehensverluste bei den Einkünften aus Kapitalvermögen berücksichtigt werden können und dass die Rechtsprechung zur Bewertung von Einlagen wertgeminderter Gesellschafterdarlehen nicht auf die Bewertung nachträglicher Anschaffungskosten anwendbar ist.
