The subject of this research is the inference of differences between the legal systems of divorce and divorce in contemporary marriage, regulated in the Macedonian family law. The main purpose of this research is the examination of countries and legislations against the possibility of divorce, whether divorce is permitted or not, as well as for the reasons for divorce, whether in their determination are taken out of the guilt of one of the spouses or not. Primary and secondary sources are used within the historical method and in particular is used the comparative technique. Therefore it is necessary to investigate the legal regulation of divorce in other countries, which is the main research hypothesis, as well the indication of the secondary hypotheses of this research that consist in analysing which of the legal systems allows or does not allow a divorce in order to ascertain that divorce is a common occurrence in contemporary conditions and is related to individual human rights and freedom and to individual liberty, respectively is the decision of the individual whether he will live in a marriage or not, whether he will initiate a divorce proceeding or will remain to live in a marital union even though for different reasons it does not work.
