LEGAL BARRIERS OF AGRICULTURAL COOPERATION AMONG B & R COUNTRIES ALONG BELT AND ROAD AND ITS PROSPECTS.

Based on the research work of the law and policy risks of farmland transacting and leasing in 17 countries along the B & R which have sister cities with Gansu Province China, this presentation is going to share some of the findings and thinking of the research, aims to show the characteristics of agricultural industry among these countries, the necessity of cooperation in agricultural industry field, and esp. the importance to precaution legal risks in it. On the one hand, there is convergence of economic model, social development stage and agricultural production conditions among these countries: that is, most of them have a long history of the agricultural civilization and strong background of agricultural production, and now they are all trying to achieve a successful transformation of social modernization and agricultural industrialization. Moreover, if we take China as an example, the well–known fact is that, China is not only divided into two different agricultural zones according to its significant rainfall difference. and interestingly (that is, the northern and southern China), but they also respectively share something in common with the One Belt in the North and the One Road in the south from the perspective of the natural geographical conditions for agricultural production, which makes the agricultural cooperation along the B & R have natural trends and comparative advantages. On the other hand, according to the theory of the New Institutional Economics, both formal and informal institutions esp. legal system and rule of law in the field of agricultural cooperation, are very important supporting force and even a decisive factor in the success or failure of agricultural cooperation. However, the diversity of tradition, culture, religion, political and legal systems existed in the B & R countries has laid a lot of institutional risks even conflict for the agricultural cooperation among the Belt & Road countries.
