This article aims to discuss, by means of the average deduction, about the impossibility of denouncing the unilateral act of the head of the Federal Executive Branch of ILO Convention No. 158. He was allowed to perform the work he took as a real punishment for a person who was doing it, being certain that, during a long period of human history, only as enslaved. However, with advances, especially technological, and the development of human thought, or work starts to assume a social character and become worthy of man, since he will seek to provide for his subsistence - and, in some cases, his family - and give dignity to your life. In this way, work is supervised by States and international organizations that seek to create, promote and expand mechanisms to protect work and workers for those conditions worthy of exercising at work. ILO Convention No. 158 was attempted to implement the Principle of Continuity of Work Relationship and, although approved and internalized in Brazil, it was denounced shortly. In this sense, this article aims to discuss the possibility of addressing these human rights and, therefore, receive supralegal status, as well as the request to participate in the participation in the national training and international extension congress. Este artigo visa discutir, por intermédio do meio dedutivo, a impossibilidade da denúncia por ato unilateral do chefe do Poder Executivo federal da Convenção nº 158 da OIT. Temse que, inicialmente o trabalho era tido como verdadeiro castigo para a pessoa que o realizava, sendo certo que, durante longo período da história da humanidade, apenas as pessoas escravizadas laboravam. No entanto, com os avanços, especialmente tecnológicos, e do desenvolvimento do pensamento humano, o trabalho passa a assumir um caráter social e tido como dignificador do homem, uma vez que este irá buscar propiciar a sua subsistência -- e, em alguns casos, de sua família -- e conferir dignidade à sua vida. Por este modo, o trabalho é tutelado por Estados e por organizações internacionais que buscam criar, fomentar e ampliar mecanismos de proteção ao trabalho e ao trabalhador para que tenham condições dignidade no exercício laboral. A Convenção nº 158 da OIT foi tentativa de concretizar o Princípio da Continuidade da Relação de Trabalho e, embora aprovada e internalizada no Brasil, foi denunciada em pouco. Neste sentido, o presente artigo tem o objetivo de discutir a possibilidade de ser esse tratado ser de direitos humanos e, portanto, receber status supralegal, bem de como de ser necessária a participação do Congresso Nacional na formação e na extinção dos tratados internacionais.
