The present article answers some questions regarding the impact and the role of the fundamental rights enshrined in the Charter of Fundamental Rights of the European Union (the "Charter") in the legal orders of the Member States. To that end, it explores in three steps the way in which the Charter is applied in the Member States. First, it explores the question of competences, by examining the way in which EU law allocates powers between the EU and its Member States in the field of fundamental rights protection with a focus on the expression 'implementing EU law' within the meaning of Article 51(1) of the Charter. Second, once it is established that a national measure is 'implementing EU law', the question that arises is whether EU law allows room for national law to provide for a higher level of protection. It is supported the contention that such a higher level of protection may take place where EU law does not provide for a uniform level of protection and in so far as 'the primacy, unity and effectiveness of EU law are [not] compromised'. The existence or absence of such a uniform level of protection is, subject to compliance with primary EU law, a question for the EU political process to resolve in the light of the principle of democracy on which the EU is founded. Third and last, in the light of recent developments in the case law of the Court of Justice, it is explored the question of the horizontal application of fundamental rights. [ABSTRACT FROM AUTHOR]
Articolul răspunde anumitor întrebări referitoare la impactul și rolul drepturilor fundamentale consacrate în Carta drepturilor fundamentale a Uniunii Europene („carta") în ordinile juridice ale statelor membre. El explorează, în acest scop, în trei pași, maniera în care carta este aplicată în statele membre. În primul rând, este explorată chestiunea competențelor, examinându-se modul în care dreptul UE alocă competențe între UE și statele sale membre în domeniul protecției drepturilor fundamentale, cu un accent asupra expresiei „punere în aplicare a dreptului UE", în sensul art. 51 alin. (1) din cartă. În al doilea rând, odată ce este stabilit că o măsură națională „pun[e] în aplicare dreptul [UE]", întrebarea care se ridică este aceea dacă dreptul UE permite dreptului național să dispună un nivel mai ridicat de protecție. Este susținută afirmația că un atare nivel mai ridicat al protecției poate avea loc atunci când dreptul UE nu dispune un nivel uniform al protecției și în măsura în care nu sunt compromise supremația, unitatea și efectivitatea dreptului UE. Prezența sau absența unui atare nivel uniform al protecției reprezintă, sub rezerva respectării dreptului primar al UE, o chestiune ce trebuie soluționată prin procesul politic al UE, în lumina principiului democrației pe care se întemeiază UE. În sfârșit, în al treilea rând, este explorat aspectul aplicării orizontale a drepturilor fundamentale, din perspectiva evoluțiilor recente ale jurisprudenței Curții de Justiție.
