After TCC Judgement No. 17 in 2023: Analysis of the Right of Physicians to Advertise in Germany and its Limitation. (English)

Pursuant to TCC Judgement No. 17 in 2023, the part of Paragraph 84 that forbidding physicians making advertisement for themselves of the Medical Care Act, in virtue of which non-medical care institutions shall not make advertisements for medical care, was declared unconstitutional and immediately invalid. The situation in Germany, where the physician was forbidden from advertising, but have been allowed to do so since 2002, was similar to Taiwan. It would be in this essay to introduce two important legal norms apropos the advertisement of physicians: Professional Regulations of the State Medical Associations and Medicinal Products Act.
