The Anglo-Boer War (1899-1902) had devastating consequences for most of the people living in Southern Africa at that time. It led to disruption and caused trauma. The struggle also produced its quota of controversial incidents (including murder cases), put the legal systems of the area under pressure, and sometimes plunged it into controversy. The death of the British lieutenant, Cecil Boyle, at the beginning of January 1901, and the ensuing court cases that followed in 1901 and 1903, led to much tension, controversy, and unhappiness - depending of course, from whose point of view the issues are looked at. In this study, the above-mentioned events, as well as the trials of Stephanus Johannes Vilonel, and of J.J. Eva, are placed in historical context, and interpreted from a legal historical point of view, in an effort to point out some of the legal implications that the Anglo-Boer War had for the people in the war zone, as well as for the post-war era. It also demonstrates that the legal and historical sciences can be complementary. [ABSTRACT FROM AUTHOR]
Die Anglo-Boereoorlog (1899-1902) het vernietigende gevolge vir die meeste van die inwoners van Suidelike Afrika ingehou, tot ontwrigting gelei en veel trauma veroorsaak. Die stryd het ook sy kwota omstrede voorvalle opgelewer, insluitend moordsake. Die regstelsel, wat in die gebied van toepassing was, is onder druk geplaas en soms in omstredenheid gedompel. Die dood van die Britse luitenant, Cecil Boyle, aan die begin van Januarie 1901 en die voortspruitende hofsake in 1901 en 1903, het tot veel spanning, omstredenheid en ongelukkigheid gelei - afhangende natuurlik vanuit wie se oogpunt na die gebeure gekyk word. In hierdie studie word die genoemde gebeure, soos ook die verhore van Stephanus Johannes Vilonel en J.J. Eva in historiese konteks geplaas en regshistories geïnterpreteer ten einde die regsimplikasies wat die Anglo-Boereoorlog vir die mense in die oorlogsgebied ingehou het (asook gedurende die periode na afloop van die stryd) uit te wys, en ook aan te dui hoe die regs- en historiese wetenskappe mekaar heel sinvol kan aanvul.
